ONLINE STORE TERMS AND CONDITIONS

§1 General Provisions

The online store is operated by Artur Sheiderov, a natural person conducting unregistered business activity pursuant to Article 5 of the Act of 6 March 2018 – Entrepreneurs’ Law.
Seller’s residential address: ul. Wierzbięcice 38/1, 61-568 Poznań, Poland.

These Terms and Conditions define the rules for using the Store, placing orders, concluding sales contracts, payments, delivery, complaints, withdrawal from the contract, returns, and sales documentation.

Sales are conducted within the scope of unregistered business activity, and the monthly revenue does not exceed the limit specified in applicable law.

The Store offers cosmetic products, in particular gels, gel polishes, and other products for nail styling.


§2 Definitions

Seller – Artur Sheiderov.
Customer – a natural person making a purchase in the Store.
Store – the online store operated by the Seller.
Product – products offered in the Store.
Sales Contract – a distance sales contract concluded between the Customer and the Seller.


§3 Placing Orders

Orders may be placed 24 hours a day, 7 days a week via the Store’s website.
Placing an order constitutes acceptance of these Terms and Conditions.
A Sales Contract is concluded at the moment the order is confirmed by the Seller.
The Seller reserves the right to refuse to process an order in justified cases.


§4 Prices and Payments

All prices in the Store are stated in Polish zloty (PLN).
The Seller is not a VAT taxpayer.

Available payment methods:
a) online payments (Stripe: payment card, BLIK),
b) other payment methods made available in the Store.

Payment must be made before the order is processed.


§4a Sales Document

The Seller is not a value-added tax (VAT) taxpayer and does not issue VAT invoices.
At the Customer’s request, the Seller issues a personal sales receipt (rachunek) confirming the sale.
The request to issue a receipt must be submitted by email within 7 days from the date of concluding the Sales Contract.
The receipt is sent to the Customer in electronic form.


§5 Delivery

Delivery is carried out within the territory of Poland, unless the offer description states otherwise.
The delivery cost and estimated delivery time are indicated during the order process.
The order processing time is calculated from the moment the payment is credited.


§6 Right of Withdrawal from the Contract

The Customer has the right to withdraw from the contract within 14 days without giving any reason, subject to paragraph 6 of this section.
The withdrawal period is calculated from the day the Product is received.
To exercise the right of withdrawal, the Customer must submit a clear statement by email or in writing.

In the event of an effective withdrawal from the contract, the Seller shall refund the payments received from the Customer (excluding delivery costs) within 14 days.
The refund shall be made using the same payment method used by the Customer, unless otherwise agreed.

The right of withdrawal does not apply to sealed products which, for health protection or hygiene reasons, are not suitable for return after the packaging has been opened, if the packaging was opened after delivery.
This applies in particular to cosmetic products, such as gels, gel polishes, bases, tops, and other nail styling products (Article 38 of the Consumer Rights Act).


§7 Product Returns

A Product return is possible only in the event of an effective withdrawal from the contract.
The Customer is obliged to return the Product within 14 days from the date of submitting the withdrawal statement.

A return is possible only if the Product:
a) has not been used,
b) is in its original, unopened, and undamaged packaging.

The direct cost of returning the Product shall be borne by the Customer.
The Seller has the right to refuse to accept a return if the packaging has been damaged or if signs of use are found.
The Seller may withhold the refund until the Product is received or proof of its return is provided.


§8 Complaints

The Seller is liable for defects in the Product in accordance with the provisions of the Polish Civil Code.
Complaints should be submitted by email or in writing.
A complaint will be processed within 14 days from the date of its receipt.


§9 Personal Data Protection

Customers’ personal data are processed in accordance with RODO (GDPR) regulations.
Detailed rules for personal data processing are set out in the Privacy Policy, available on the Store’s website.


§10 Final Provisions

These Terms and Conditions enter into force on the date of their publication on the Store’s website.
In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply.
